Privacy Policy

This policy explains what personal information Nijanand Fitness Centre collects when you use our website, book an appointment, join an online class, or message us on WhatsApp — and how you can ask us to delete it.

Section 01Who we are

Nijanand Fitness Centre ("NFC", "we", "us") is a physiotherapy, yoga and fitness centre based in Varachha, Surat, Gujarat, India. We operate this website, our online class platform, and our official WhatsApp and Facebook business channels.

For the purposes of data protection law, Nijanand Fitness Centre is the data controller for the information described in this policy.

Section 02Information we collect

We only collect information that we need in order to provide our services to you.

We do not buy contact lists, and we do not collect information about you from third parties without your knowledge.

Section 03Meta, Facebook and WhatsApp data

We use Meta's business tools — including Facebook Login for Business, the Facebook and Instagram Pages we manage, and the WhatsApp Business Platform — to communicate with our patients and members.

If you sign in using Facebook

When you choose to connect a Facebook or Instagram business account to our application, Meta shares a limited set of information with us: your name, profile picture, the email address on your Meta account, and the Pages or business accounts you have authorised us to manage. We use this only to link your account and to send or receive messages on your behalf. We do not post to your account without your instruction, and we do not access your personal friends list, photos, or private posts.

You can review and remove our application's access at any time from your Facebook settings, under Settings & Privacy — Settings — Apps and Websites.

If you message us on WhatsApp

When you message our WhatsApp business number, we receive your WhatsApp phone number, your WhatsApp profile name, and the content of the messages you send. We use this to answer your questions, confirm appointments, send class links and reminders, and share health education material you have opted in to receive.

We send template messages only to people who have given us their number and consented to receive them. You can stop receiving messages at any time by replying STOP to that WhatsApp number, or by telling us at reception.

Messages sent through Meta's platforms are also processed by Meta under its own terms. Meta's handling of your data is described in the Meta Privacy Policy and the WhatsApp Privacy Policy.

Section 04How we use your information

  • To plan and record your physiotherapy treatment
  • To give you access to online classes, recordings and exercise programmes
  • To answer your questions on WhatsApp, phone, email or social media
  • To process payments and issue receipts
  • To send health education content and centre updates, where you have opted in
  • To keep our website and services secure and working properly
  • To meet our legal, tax and professional record-keeping obligations

We do not sell your personal information, and we do not share it with advertisers.

Section 05Health information

As a physiotherapy practice, we record clinical information such as your symptoms, assessment findings, diagnosis, treatment plan and progress notes. This is sensitive personal data and we treat it accordingly.

Clinical records are accessible only to the treating physiotherapist and authorised clinical staff. We do not send clinical details over WhatsApp or social media unless you have specifically asked us to, and we never discuss your case with another person — including a family member — without your permission, except where the law requires it.

Section 06Who we share it with

We share your information only in these situations:

  • Service providers who run parts of our operation on our behalf — website and database hosting, video conferencing for online classes, payment gateways, and messaging providers. They may only use the data to provide that service to us.
  • Meta Platforms, where you contact us through WhatsApp, Facebook or Instagram, as part of delivering those messages.
  • Referral partners — such as a consulting doctor or diagnostic centre — but only with your consent.
  • Legal authorities, where we are required by Indian law or a valid court order to disclose information.

Section 07How long we keep it

We keep clinical records for as long as professional and legal record-keeping standards require. Contact details and marketing preferences are kept until you ask us to remove them. Website analytics data is kept in aggregated form only. When information is no longer needed, we delete it or make it permanently anonymous.

Section 08How we protect it

Our website and online class platform are served over encrypted HTTPS connections. Access to patient records is restricted to authorised staff using individual accounts. Physical records are stored securely at the centre. We review access permissions periodically.

No system is completely secure. If a breach affects your personal information, we will inform you and the relevant authority as required by law.

Section 09Your rights

Under India's Digital Personal Data Protection Act, 2023 — and, where it applies to you, the EU General Data Protection Regulation — you may:

  • Ask what personal information we hold about you
  • Ask us to correct anything that is wrong or out of date
  • Ask us to delete your information (see the next section)
  • Withdraw consent for marketing or WhatsApp messages at any time
  • Ask us to restrict how we use your information
  • Nominate someone to exercise these rights on your behalf
  • Raise a complaint with the relevant data protection authority

We respond to these requests within 30 days. We may ask you to verify your identity first, so that we do not release your information to the wrong person.

Section 10Deleting your data

You can ask us to delete the personal information we hold about you at any time, free of charge. Here is exactly how:

  1. Email pakoladiya@gmail.com with the subject line "Data deletion request", or send us a WhatsApp message on our official business number.
  2. Include the name and phone number or email address you used with us, so we can find your records.
  3. We will confirm receipt within 3 working days and verify your identity.
  4. We will delete your data within 30 days and confirm in writing once it is done.

If you connected a Facebook or Instagram account to our application, you can also revoke that connection directly from Facebook under Settings & Privacy — Settings — Apps and Websites. Removing the app there stops any further data being shared with us; email us as well if you want the data we already hold to be erased.

One limit applies: where professional or legal rules require us to retain a clinical record for a minimum period, we will restrict access to that record rather than destroy it, and delete it once that period ends. We will tell you if this applies to your request.

Section 11Cookies

Our website uses cookies to keep you signed in, remember your preferences, and understand which pages are useful. You can block or delete cookies in your browser settings; some features, such as staying signed in to online classes, will not work if you do.

Section 12Children

Our online services are not directed at children under 18. Where we treat a child at the centre, we collect their information only from a parent or legal guardian, and only for clinical purposes. If you believe a child has given us information online without a guardian's consent, contact us and we will remove it.

Section 13Changes to this policy

We update this policy when our services or the law change. The date at the top of the page always shows the current version. If a change materially affects how we use your information, we will tell you by email or WhatsApp before it takes effect.
